On 24-02-2015, Rajya Sabha passed the Public Premises (Eviction of Unauthorised Occupants) Amendment Bill, 2014. The objective of the Bill is to promote urban development and enable quick execution of infrastructure projects. The Bill seeks to empower Delhi Metro Rail Corporation, other Metros, Public Transport Companies, Companies of Delhi Government, New Delhi Municipal Council and successors to Major Port Trusts to get their properties and premises evicted of unauthorised companies in a speedy manner. The Bill provides for strict time frames for completion of eviction proceedings in order to prevent the misuse of procedures, and also provides adequate safeguards to prevent any misuse of the provisions of the Bill. The Bill incorporates provision with regard to specific time frames for serving notices for vacation, disposal of appeals, fixation of the quantum of rent to be charged and subsequent eviction, condonation of delays in vacation only in exceptional cases and not as a general rule etc. The Bill also contains provision for a Summary Trial, disposal of appeals by the District and Sessions Judge, substitution of Municipal Corporation of Delhi in the Act with the newly created Corporations and maximum time limit for disposal of the cases by the Estate Officers. Earlier, the Bill was passed by Lok Sabha on 15.12.2014.
