The Central Government in exercise of power conferred by Section 3(1) of All India Services Act, 1951, makes Indian Administrative Service (Cadre) Second Amendment Rules, 2016 in order to amend the Indian Administrative Service (Cadre) Rules, 1954. The said Rules will into force on the date of their publication in the Official Gazette. In the Indian Administrative Service (Cadre) Rules, 1954,—
(a) in sub-rule (5) of rule 7, for the proviso, the following shall be substituted, namely:—
“Provided that the Competent Authority may amend, modify or reject the recommendation of the Civil Services Board
by recording the reasons in writing therefor.”
(b) In the Schedule, for serial number 3, the following shall be substituted, namely:—
“3. Procedure.— (1) (a) The Civil Services Board may obtain the information from the Administrative Department of the State concerned or any other relevant sources while considering the transfer of an officer before completion of specified tenure.
(b) The Civil Services Board shall submit annual report on 1st January to the Central Government about the date of the Civil Services Board meetings in the prescribed Form annexed to the Schedule and also upload the same on the website of the concerned State Government or Union territory in public domain.
(2) The Competent Authority may amend, modify or reject the recommendation of the Civil Services Board for the reasons to be recorded in writing.
