Uttaranchal High Court: The Division Bench of Uttaranchal High Court comprising of K.M. Joseph, C.J and V.K. Bist, J., struck down the Government of India’s decision to impose President’s Rule in the State of Uttarakhand. The Bench was critical of the decision and termed it as “undermining the foundation of federalism and breeding cynicism in the hearts of citizens who participate in a democratic system”. The Court even went on to state that the Government’s move to impose President’s Rule and its arguments supporting it was riddled with “blatant falsehood” and chided the Government for its “undue interference” in the affairs of the State Assembly. The Bench therefore ordered that the Uttarakhand Government would undergo the floor test in the Assembly on 29th April, 2016.
The decision has been welcomed by the State Government and several political factions. However the Union Government has decided to move the Supreme Court against the decision.
