S.O. 535(E).— Whereas, the Government of India signed an inter-governmental Memorandum of Understanding for establishing the Asian Infrastructure Investment Bank (hereinafter referred to as the Bank) on 24th October, 2014;
And whereas, the Government of India signed the Articles of Agreement establishing the Bank on 29th June, 2015 and ratified the said Agreement on 18th December, 2015;
And whereas, Article 44, 45, 46, 47, 48, 49, 50, 51, 52 of Chapter IX of the Articles of the said Agreement provide for privileges and immunities of the Bank and its representatives and officials;
And whereas, the Central Government considers it expedient to extend the necessary privileges and immunities provided under the United Nations (Privileges and Immunities) Act, 1947 (46 of 1947) to the Bank and its representatives and officials;
Now, therefore, in exercise of the powers conferred by Section 3 of the United Nations (Privileges and Immunities) Act, 1947 (46 of 1947), the Central Government hereby declares that the provisions of Section 1 of Article I, Sections 2, 3, 4, 5, 6 and Section 7 of Article II, Section 9 of Article III, clauses (a), (b), (c), (d) and (e) of Section 18 and Section 20 of Article V and clauses (a), (b), (c), (e) and (f) of Section 22 of Article VI of the Schedule to the said Act shall apply, mutatis mutandis, to the Asian Infrastructure Investment Bank, its representatives and officials.
