Himachal Pradesh High Court: A Division Bench comprising of Surya Kant, CJ. and Ajay Mohan Goel, J. directed the respondents to ensure that the prescribed rules and conditions for setting up a slaughterhouse were meticulously complied with.
The writ petition was filed in public interest relying upon some news items where different sections of society objected regarding setting up of slaughterhouses in the residential surrounding areas. As per the conceptual plan of the area the location was suggested in the mid of residential area, hospital etc. and as a result, the waste of the slaughter birds was likely to cause pollution and emanate foul smell.
After going through the requisite conditions for the grant of permission to operate slaughterhouses, the court was of the view that all the mandates shall be taken into consideration and every slaughterhouse shall have requisite facilities for operating the same with keeping into account the requirements of the local surrounding residents.
Accordingly, the Court directed the respondents to make sure that all necessary preventive measures were taken with respect to the waste generated ensuring no nuisance to the adjoining areas. [Sharwan Kumar v. State of H.P,2018 SCC OnLine HP 1695, order dated 27-11-2018]
