Jharkhand High Court: A Bench of Ananda Sen, J. dismissed a petition seeking a declaration of result on having been qualified, finding no illegality in withholding the result by the Jharkhand Academic Council (JAC).
In the present matter the petitioner through the learned counsel Mr Surendra Pd. Sinha, had submitted that his name was reflected in the provisional merit list as a successful candidate but his result was not declared for unknown reasons. He further prayed for a direction upon respondents to issue mark sheet of JTET Examination-2016, in which he appeared and stood qualified. Subsequently, a counter affidavit was filed by the respondents through the learned counsel Mrs Sanchita where the name of the petitioner was indicated with a * (star mark) in the provisional merit list. The star mark meant that it was subject to verification, upon which it was found that the petitioner did not darken the OMR sheet against column no. 8, in respect of Language-I.
The Court found the statement so made by the learned counsel for the respondents to be correct and found no illegality in JAC declaring the OMR sheet to be defective and the withholding of the result as a subsequent consequence.
