As reported by media, the Division Bench of the High Court has upheld the Maratha Reservation for educational institutions and appointments to posts in public services as provided by the Maharashtra Government but says “16% is not justifiable”. A petition had challenged its constitutional validity. The Judgment was reserved after hearing the petitions on 26-03-2019.

Background:

Maharashtra legislature passed a bill proposing 16 per cent reservation in education and government jobs for the Marathas under the Socially and Educationally Backward Class (SEBC) category. Governor of Maharashtra had granted his assent to the Maharashtra State Reservation for Socially and Educationally Backward Classes Act, 2018.

This increased the reservation in Maharashtra from 52 per cent to 68 per cent, far beyond the 50 per cent cap set by the Supreme Court.

Following the decision, several petitions were filed challenging the decision.

Nagpur bench of the Bombay High Court had rejected a plea against the state government’s ordinance to retain 16% reservation for Marathas under the socially and educationally backward classes (SEBC) category in post-graduate medical and dental courses.
