Patna High Court: Shivaji Pandey, J. disposed of the writ application with the direction that the Registrar of Trade Unions should examine the application of the petitioners and take a decision in accordance with the law.
The petitioner made a request for recolonization of the Trade Union which has been formed by the employees of the Bank. The Court found that in the Central Bank of India, Patna Zone, two Unions were operating, which decided to form a single platform. This led to the creation of a single platform for raising the grievance of the employees.
It was contended before the Court that certain persons, who were members of Bihar State Central Bank Employees’ Association revolted against the decision of merger and formed a separate group and refused to recognize the merger of the two Unions. This newly formed group expelled other members of the original union and is claiming that they are the members of Bihar State Central Employees Union. In this regard, they also made a prayer for recognition of their group as the original unliquidated association.
The Court held that they could only give direction to the Registrar of Trade Unions to examine the application of the petitioners and, after giving notice to all the parties concerned, the Registrar of the Union should take a decision in accordance with the law.
