On 3-1-2023, the Ministry of Communications has notified the Indian Telegraph (Infrastructure Safety) Rules, 2022. The Rules came into effect on 3-1-2023.

Key Points:

  1. In case a person has to dig or excavate and while doing so, a telegraph infrastructure can be damaged or if it may interrupt or interfere with telegraphic communication, that person has to give notice to licensee through common portal before starting the excavation.

  2. On receiving such notice, the licensee has to provide the details of telegraph infrastructure owned/ controlled/ managed by him and suggest precautionary measures in order to avoid damage.

  3. In case, the licensee does not provide the details of the telegraphic structure within 1 month, the person having the legal right to excavate will be free to do so.

  4. In case of breach of the provisions of the Rules, the person causing damage is liable to pay the damages to the telegraph authority and the damage will be calculated on expenses incurred in restoring damages.
