About CHRIST (Deemed to be University)
School of Law, CHRIST (Deemed to be University) (SLCU), Bangalore, is a part of CHRIST (Deemed to be University), Bangalore, which was founded and is administered by Carmelites of Mary Immaculate (CMI). CMI, the first indigenous Catholic religious congregation of India with a membership of 2000, renders its service to humanity in educational, social, healthcare and other activities. The parent university, a premier educational institution, is an academic fraternity of individuals dedicated to the motto of excellence and service and already has a proven history of success in the field of education. Though it is a minority institution, CHRIST (Deemed to be University) maintains a secular outlook towards education. Students of all castes, religions, creeds and languages are encouraged to be a part of this temple of learning. About the Alternative Dispute Resolution Board
The Alternative Dispute Resolution Board aims to promote and provide learning opportunities to experience the various alternative means of dispute resolution within the legal system. The Board is committed to conducting several events to provide the student community with the necessary exposure to deal with aspects concerning Arbitration, Mediation, Negotiation, Conciliation etc.
MED-ARB Details
The 3rd National Med-Arb Competition is the Third edition of the flagship event of the Alternative Dispute Resolution Board, School of Law. The aim is to create a platform for like-minded individuals interested in Alternative Dispute Resolution to indulge in an intellectual and thought-provoking competitive simulation of Mediation and Arbitration. The competitions will be held from the 3rd of March to the 5th of March 2023. The brochure holds detailed information regarding the competition. The competition will be divided into two parts Mediation and Arbitration.
MEDIATION:
Mediation is an alternative method of resolving disputes without resorting to the courts. It is a structured, voluntary and interactive negotiation process where a neutral third-party uses specialized communication and negotiation techniques to help the parties fulfil their stated objectives. As a party-centred process, it focuses on the interests, needs and rights of the parties.
ARBITRATION:
Arbitration is a procedure in which a dispute is submitted, by agreement of the parties, to one or more arbitrators who make a binding decision on the dispute. In choosing arbitration, the parties opt for a private dispute resolution procedure instead of going to court.
Competition Details
Composition of the Team:
Each participating team shall consist of 3rd members, where two members shall act as a client and counsel pair and one member as Mediator/Arbitrator. The role of the members shall not be changed (i.e., the participant in the role of Mediator/Arbitrator shall continue to play the role throughout the competition). The Arbitration rounds shall constitute 2 Counsels from each team. No team shall be accompanied by a coach/Instructor.
Nature of the Competition: All the teams shall participate in both sessions (a Mediation Session followed by an Arbitration Session) in all the rounds. There will be a provisional cap of 30 teams who will be invited from leading law schools in India (the number of teams is subject to change based on the discretion of the ADR Board).
Structure of Rounds:
a) Preliminary Rounds- All Competing Teams.
b) Quarter- Finals 8 top teams from preliminary rounds.
c) Semi-Finals- 4 top teams from the Quarterfinal rounds.
d) Finals-2 top teams from the Semi-final rounds. The participant acting as arbitrator for a particular session shall individually prepare an arbitral award within the time allotted for such an Arbitral award drafting session.
