On 8-3-2023, the Government of Tamil Nadu notified the Tamil Nadu Civil Services (Appointment on Compassionate Grounds) Rules, 2023.
Key Points:

Under these rules, a Government Servant (‘GS') means a person who has been appointed to any service/ post in connection with the affairs of the State and includes a probationer, an approved probationer and a full member of a service.

The family members of the following GS will be eligible for appointment on compassionate grounds:

GS including those who are under suspension who died in harness,

GS, who retired on medical invalidation, with not less than 5 years of left over service and,
-
Missing Government servants, who were declared to be dead with effect from a date anterior to the date of their superannuation.

The priority for appointing on compassionate grounds will be:

Legally wedded spouse
-
Son/ Daughter- Legitimate or Adopted
-
Parents
-
Brother/ Sister
-

Time limit to make application- within 3 years from the date of death/ retirement on medical invalidation or when the Court orders that the missing GS is declared to be dead.

Appointment will be confined to Group ‘C' & Group ‘D' posts depending upon the educational qualifications of the applicant.

Reservation provided under Tamil Nadu Government Servants (Conditions of Service) Act, 2016 will not apply to appointments made under these rules.

In Group ‘C' the total number of compassionate appointments made in any department cannot exceed 5% of the total sanctioned strength. Whereas there is no such ceiling for Group ‘D'.

Each appointing authority will have to regularize the services of the person appointed under these rules within a period of 1 year from the date of his joining service.
