  • Section 441 in The Indian Penal Code
    441. Criminal trespass.—Whoever enters into or upon property in the possession of another with intent to commit an offence or to intimidate, insult or annoy any person in possession of such property, or having lawfully entered into or upon such property, unlawfully remains there with intent thereby to intimidate, insult or annoy any such person, or with intent to commit an offence, is said to commit “criminal trespass”.

The punishment for the offence of criminal trespass is given in Section 447,
    Which states that:

“Punishment for criminal trespass- Whoever commits criminal trespass shall be punished with imprisonment of either description for a term which may extend to three months, or with fine which may extend to five hundred rupees, or with both.

A company, a Solar Power Company, neighbouring to our company premises, had trespassed into our land by laying EHT Power Lines across the middle of our factory premises in the year 2018. He had not removed the Power Lines even today. It is a continuing Criminal Trespass. We, however, sold that land and moved to a different place. We had lodged a Police Complaint and the matter is in the criminal courts.
Now, what would be the punishment likely to emerge in the court case?
It is a continuing Criminal Trespass for over 4 years and 6 months.

Is the pecuniary punishment is just Rs.500/- as per Sec.447 for a trespass over 4-1/2 years?

Is it Rs.500/- per day or Rs.500/- per month or Rs.500/- for the entire period of trespass, let the trespass be for over 10 years?

What is the parameter which the courts will have while awarding pecuniary Punishment?
