Punjab and Haryana High Court: In a Criminal Writ Petition filed before the Court seeking issuance of habeas corpus writ against Punjab Police to produce Amritpal Singh, alleged of being illegally detained by the authorities, N.S. Shekhawat, J. issued notice to the State to revert on the instant matter.

The petitioner allegedly being the legal advisor of ‘Waris Punjab De’ filed the present petition under Article 226 of Constitution of India seeking issuance of writ of Habeas Corpus directing the State to produce Amritpal Singh who has allegedly been illegally and forcibly detained by the Police without being authorized by law.

It is alleged that Amritpal Singh is the head of the ‘Waris Punjab De’, an organization allegedly formed to fight for social justice and preserve the rights and culture of Punjab. The petitioner alleges that the respondents along with Central Para Military Forces (‘CRPF’) illegally and forcibly detained Amritpal Singh without disclosing any reasons and that he was not even informed of the grounds of arrest.

It has been further alleged that Amritpal Singh has been detained for more than 24 hours and the Police are not disclosing anything about his whereabouts. It is further contended that the petitioner approached all the authorities concerned for release of Amritpal Singh, but nobody paid any heed to those requests.

The Court in the instant matter issued notice to the Government of Punjab. The Senior DAG of Punjab accepted the notice on behalf of the State and sought time for filing a detailed reply before the Court.

The matter was further scheduled for 21-3-2023 and has been listed again on 27-3-2023.
