On 5-4-2023, the Ministry of Health and Family Welfare notified the Surrogacy Regulations, 2023. The provisions came into force on 5-4-2023.
Key Points:
For both National Assisted Reproductive Technology and Surrogacy Board and State Assisted Reproductive Technology and Surrogacy Board the following conditions/procedures for the meetings of Board mentioned under the Surrogacy (Regulation) Act, 2021, Section 19(1) apply:

The Boards will meet at least once in 6 months with a quorum of 50%.

In case 50% of the quorum is not present at the starting of the meeting then the meeting will be adjourned.

In case of adjournment, the business of that meeting will be transacted in another meeting which can be scheduled after 2 hours but not beyond 7 days, irrespective of the quorum requirements.

The meeting can be conducted virtually or physically on the date/ place/ venue decided by the Chairperson of the Board.

The Member Secretary will have to issue notice of every meeting to every Member not less than 15 days before the date of the meeting along with the agenda emphasizing the business to be discussed in such meeting.

Any member who wants to move any motion apart from the agenda circulated by the Member Secretary of the Board will have to give notice for inclusion of the same at least 7 days before the meeting.

The Boards also have the authority to co-opt a person to attend meetings and temporarily associate with the Boards.
